General Terms of Service

Introduction: Nexia.host, operated by Nexia Digital Solutions Limited, is an internet information provider offering storage and transfer services through its web servers. By utilizing our services, you acknowledge that the internet is not owned or controlled by any single entity, and we cannot guarantee uninterrupted access to our servers.
Service Availability: Nexia.host is committed to making every good faith effort to ensure widespread server availability with minimal service interruption. However, due to the nature of the internet, we cannot guarantee continuous access for every user at all times.
Financial Arrangements:
- Contract Duration: Customer agrees to a minimum thirty (30) day contract, the exact duration of which is determined at the time of signup.
- Billing and Charges: All charges and fees associated with an account are the sole responsibility of the customer.
- Cancellation and Refunds: Customers may cancel shared web hosting services within thirty (30) days of signup for any reason (except for Terms of Service or Spam Policy violations) and receive a prompt refund. Refund policies are outlined on our website.
Billing and Payments:
- Automatic Renewal: Contracts automatically renew for the original duration until canceled in writing or via the web panel. Customers can pre-authorize recurring transfers from a linked credit card account.
- Refunds: Refunds are applicable only to credit card payments for shared web hosting within the first 30 days. Other forms of payment are non-refundable.
Service Level Agreements (SLAs):
- Uptime Guarantee: Nexia.host guarantees 99.9% uptime for the GoFaster2 service. If this level is not met, customers may be eligible for service credits based on the Unavailability as defined in our SLA.
- Service Credits: Credits will be calculated as a percentage of the bill for the billing cycle in which Unavailability occurred. Claims must be submitted within 14 days of Unavailability.
Taxes: Nexia.host is not liable for any taxes associated with customer purchases. Customers are responsible for all taxes related to the products sold.
Material Products: Customers are required to provide material and data in a "server-ready" condition. Nexia.host is not responsible for validating content but reserves the right to police its network for compliance.
Use of Services: Customers using Nexia.host's services must have the necessary knowledge in internet languages, protocols, and software. Nexia.host is not obligated to provide knowledge or support beyond defined service offerings.
Limited Liability:
- Disclaimer: Nexia.host makes no warranties or representations regarding the service provided.
- Damages Limitation: Nexia.host is not liable for direct, indirect, or consequential damages resulting from service use. Damages are limited to the pro-rata monthly charge during system unavailability.
Hardware and Software: Customers are responsible for providing necessary equipment and services to access Nexia.host. Nexia.host makes no assurances regarding equipment compatibility.
Dedicated Servers and GoFaster Stipulations:
- Billing and Refunds: Dedicated server payments are nonrefundable. Termination or upgrades of GoFaster services are subject to specific refund and billing procedures.
- Security Responsibilities: Managed server security is Nexia.host's responsibility, while unmanaged servers require customer attention to maintain security.
VPS Services: All VPS services are unmanaged, requiring customers to handle maintenance, backups, and security.
Age: Customers must certify that they are at least 18 years old or have a legal guardian acting on their behalf.
Termination: Either party may terminate the contract with 14 days' notice. Nexia.host may terminate services immediately for non-compliance or non-payment.
Limited Liability: Customers acknowledge that server use is at their sole risk. Nexia.host is not liable for interruptions, errors, or the accuracy of information provided.
Promotional Codes: Customers using promotional codes waive the option to indicate referrers. Codes are for new customers only, and changing a code after signup is not permitted.
Indemnification: Customers agree to defend and indemnify Nexia.host against any liabilities arising from services provided or products sold.
Sanctioned Countries: Customers agree to comply with export control laws. Nexia.host is not liable for fines resulting from customer breaches of export control laws.
Other Agreements: Customers must abide by additional policy documents, including Acceptable Use Policy, Anti-Spam Policy, Unlimited Policy, Privacy Policy, and Customer EU Data Processing Addendum.
Contract Revisions: Revisions will be applicable to previous contracts upon renewal of service.
Transfer: Customers may not transfer this contract without written consent from Nexia.host.
Contract: These terms constitute the entire contract. Changes are agreed upon by both parties upon service renewal.

Not Allowed:
SPAM - Any site operator who uses/stores any kind of spamming software, or whose spamming activities affect our servers negatively in any way, will have their accounts terminated without warning.
Mailing lists - Mailing lists such as mailman, majordomo, PHPlist, etc. are not allowed to run from our servers regardless of the contents of these lists' messages or size, and even with "obtained" addresses.
MLM - Any mailing, posting or content of "Make Money Fast" (MMF) or "Fast Cash" or pyramid schemes or chain letters or MLM (multi level marketing) schemes of any sort will result in quick account termination.
HYIP - High Yield Investment related or linked to websites.
Illegal Material/Actions - This includes copy-righted works, commercial audio, video, or music files and any material or actions in violation of any Federal, State or Local regulations.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of us. Contact us first if you think that you may violate this term.
IRC bots - IRC bots such as Eggdrop, IRCD, PSY BNC etc. are prohibited.
Shell scripts - Shell scripts such as those that try to gain shell access or to run system command lines are prohibited.
Warez - Includes pirated software, ROMS, emulators, freaking, hacking, password cracking or cheating, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
BitTorrent: Or any thing related to bit torrents are not allowed to be hosted on our web servers.
Proxy: Proxies websites, scripts, etc. are not allowed.
Phishing: The illegal collection of personal information over the internet is obviously not allowed.
Downloads: Storing an excessive amount of downloads is not allowed.
Refund Policy:
We will refund payments for web-hosting packages up to 72 hours after initial payment has been made if you are not satisfied with our service and have not violated any of the Terms of Service stated above. Setup fees and domain registrations are not refunded under any circumstance.
